Abstract
This article discusses the scope and application of the Charities (Regulation and Administration) (Scotland) Act 2023 which amends the Charities and Trustee Investment (Scotland) Act 2005 to enhance transparency, and strengthen the regulation, of charities in Scotland. Compares this approach with that of England and Wales under the Charities Act 2022 which aims to reduce the administrative burdens for charities, enhances their powers and moves towards deregulation of the sector.
