Abstract

The author reviews the background of the the Hate Crime and Public Order (Scotland) Act 2021 and it's impact and complexity of implementation. The primary objective of the law was to offer enhanced protection for victims and communities by consolidating existing laws (such as s.96 of the Crime and Disorder Act 1998 (repealed by the Act on 1 April 2024) and s.74 of the Criminal Justice (Scotland) Act 2003) and introducing new offences related to threatening or abusive behaviour intended to stir up hatred.
