Abstract

An alternative dispute resolution mechanism was not simply a means of handling disputes arising in the accident compensation scheme in New Zealand. Rather it was inherent in the creation of the scheme, and might even be thought of as part of its rationale. The "no fault" accident compensation system (now commonly "ACC" ) was first formulated in the visionary Report of the Royal Commission of Inquiry into Compensation for Personal Injury in New Zealand chaired by Sir Owen Woodhouse ('the Woodhouse Report'). Originally envisaged as evaluating only workers' compensation provisions, the Royal Commission took the daring step of extending its own remit to encompass all personal injuries, whether at work or not.
