European human rights in the era of pushbacks: some current issues.

Abstract

This paper reflects on some key developments in relation to "pushbacks" at both the European Court of Human Rights and the Court of Justice of the European Union. The reflection will be set in the context of the complementarity, and otherwise, that exists between these two courts in their approaches towards pushbacks at European borders. There will be a key focus on 2020 judgments from both the European Court of Human Rights and the Court of Justice of the European Union. The paper then centres on more recent jurisprudence concerning Greece and Belarus. As the long journey towards EU Accession to the ECHR continues, the paper will consider how divergence on issues such as pushbacks could be accommodated within this eventual framework.
